Xevigo
These Terms of Use ("Terms") govern your use of the mobile applications published by Xevigo ("we," "us," or "our"), including AirGameBox (the "App"). Please read them carefully. By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, please do not use the App.
1. License to Use the App
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download and use the App on Apple-branded devices that you own or control, for your personal, non-commercial use, in accordance with the App Store Terms of Service and Apple's usage rules.
2. Acceptable Use
You agree that you will not:
- copy, modify, distribute, sell, lease, or sublicense any part of the App;
- reverse engineer, decompile, or attempt to extract the source code of the App, except to the extent permitted by applicable law;
- use the App in any way that violates applicable laws or regulations;
- interfere with or disrupt the operation of the App, or attempt to gain unauthorized access to any related systems; or
- remove or alter any copyright, trademark, or other proprietary notices contained in the App.
3. Intellectual Property
The App — including its games, graphics, sounds, design, code, and the Xevigo and AirGameBox names and logos — is owned by Xevigo and is protected by copyright, trademark, and other intellectual property laws. These Terms do not grant you any rights to our trademarks or other brand elements.
4. Updates and Changes to the App
We may release updates that add, modify, or remove features of the App at any time. We may also suspend or discontinue the App, in whole or in part, at our discretion. We are not obligated to provide any particular update or to maintain any specific feature.
5. Privacy
Your use of the App is also governed by our Privacy Policy, which describes what information we collect and how we handle it.
6. Disclaimer of Warranties
The App is provided "as is" and "as available", without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, or free of harmful components.
7. Limitation of Liability
To the maximum extent permitted by applicable law, Xevigo shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill, arising out of or related to your use of (or inability to use) the App. In no event shall our total aggregate liability exceed the amount you paid for the App (if any) in the twelve months preceding the claim, or fifty US dollars (USD $50), whichever is greater.
Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability, so some of the above limitations may not apply to you.
8. Apple-Specific Terms
These Terms are between you and Xevigo only, not with Apple Inc. ("Apple"). Apple is not responsible for the App or its content. Apple has no obligation to provide maintenance or support services for the App. In the event of any failure of the App to conform to an applicable warranty, you may notify Apple, and Apple may refund the purchase price (if any); to the maximum extent permitted by law, Apple has no other warranty obligation with respect to the App. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
9. Termination
These Terms are effective until terminated. Your rights under these Terms will terminate automatically if you fail to comply with them. Upon termination, you must stop using and delete the App. Sections that by their nature should survive termination (including intellectual property, disclaimers, and limitations of liability) shall survive.
10. Changes to These Terms
We may revise these Terms from time to time. When we do, we will update the "Last updated" date at the top of this page. Your continued use of the App after revised Terms take effect constitutes acceptance of the changes.
11. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Xevigo operates, without regard to conflict-of-law principles. Nothing in these Terms limits any mandatory consumer protection rights you have under the laws of your country of residence.
