These Terms of Use ("Terms") govern your use of AirGameBox (the "App"), published by Xevigo ("we," "us," or "our"). By downloading or using the App, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the App.

1. Eligibility and Accounts

The App is intended for users who meet its App Store age rating. If you are under the age at which you may independently consent where you live, a parent or legal guardian must authorize your use.

You may begin with an automatically created guest account. You are responsible for activity under your account and for keeping access to your device secure. Sign in with Apple is optional and may be used to link or restore an account. Do not sell, transfer, impersonate another person with, or obtain unauthorized access to an account.

Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the App on Apple-branded devices that you own or control, in accordance with Apple's usage rules. No ownership rights are transferred to you.

3. Multiplayer and Communications

Game modes vary by game. Nearby play depends on compatible physical devices, local-network permission, device availability, and network conditions. Remote play, account sync, messaging, group features, and notifications depend on an internet connection and our online services. We do not guarantee that another player, a particular mode, or any online service will always be available.

4. User Content

"User Content" includes nicknames, profile text, messages, group information, photos, audio, videos, documents, filenames, and other material you create, send, or make available through the App.

You retain ownership of your User Content. You grant us a limited, worldwide, non-exclusive, royalty-free license to host, store, reproduce, transmit, format, display to your intended recipients, and process that content only as reasonably needed to operate, secure, moderate, and improve the App or comply with law. This license ends when the content is deleted from active systems, except for limited backups, safety records, legal obligations, or content retained by other users.

You represent that you own your User Content or have all permissions needed to share it and grant this license. Do not share protected music, media, confidential information, or other material unless you are authorized to do so.

5. Safety and Acceptable Use

You must not use the App to:

• post, send, or promote illegal, sexually explicit, exploitative, threatening, hateful, harassing, deceptive, or seriously offensive content;

• bully, stalk, impersonate, defraud, or expose another person's private information;

• send spam, malware, executable code, installers, scripts, or content designed to damage a device or service;

• circumvent content filters, rate limits, access controls, bans, or security measures;

• reverse engineer, disrupt, overload, scrape, or gain unauthorized access to the App or its systems, except where applicable law expressly permits it.

The App provides content filtering, reporting, and blocking tools. We may review reports and remove content, restrict features, block delivery, suspend or terminate accounts, preserve evidence, or contact authorities when reasonably necessary. Automated filters cannot identify every harmful item, so use care and report problems promptly.

6. Attachments and Nearby Transfers

Only send files to people you trust and only accept files from known senders. File type and size limits may apply. Transfers may fail because of storage, network, operating-system, or device conditions. Nearby transfers are peer-to-peer and the recipient decides whether to accept. We do not guarantee that a file is safe, compatible, complete, or available after transfer.

7. Account Deletion and Termination

You may delete your current account through Settings > Account > Delete Account Data. Deletion removes eligible local and cloud account data and creates a fresh guest profile. Some limited records may remain for backups, fraud prevention, safety reports, dispute resolution, or legal compliance as described in the Privacy Policy.

We may suspend or terminate access if you materially or repeatedly violate these Terms, create a safety or security risk, or use the App unlawfully. Where appropriate, we may give notice or an opportunity to appeal by contacting support.

8. Intellectual Property

Except for User Content, the App and its games, code, graphics, audio, designs, documentation, and Xevigo and AirGameBox names and logos are owned by or licensed to us and protected by applicable laws. These Terms do not grant you any rights to our trademarks or other brand elements.

The current version is free and contains no advertising, subscriptions, or in-app purchases. Your carrier or internet provider may charge for data use. Apple services and external websites are governed by their own terms and privacy policies.

10. Updates and Availability

We may update, replace, suspend, or discontinue features or services. Changes may be required for security, legal compliance, compatibility, or product improvement. We are not obligated to maintain a particular feature, game mode, server, or compatibility with an obsolete App version.

11. Disclaimers

To the maximum extent permitted by law, the App is provided "as is" and "as available" without express or implied warranties. We do not warrant uninterrupted operation, error-free service, successful matchmaking or transfers, preservation of every item of data, or the conduct or content of other users. Nothing in these Terms excludes rights that cannot legally be excluded.

12. Limitation of Liability

To the maximum extent permitted by law, Xevigo will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or loss of data, profits, opportunity, or goodwill arising from the App. Our aggregate liability will not exceed the greater of the amount you paid us for the App during the twelve months before the claim or USD $50. Some jurisdictions do not allow certain exclusions or limits, so they may not apply to you.

These Terms are between you and Xevigo, not Apple Inc. Apple is not responsible for the App or its content and has no obligation to provide maintenance or support. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce the applicable provisions against you. Your use must also comply with the App Store Terms of Service and Apple's usage rules.

We may revise these Terms and will update the date above. Continued use after revised Terms take effect means you accept them. These Terms are governed by the laws applicable where Xevigo operates, without limiting mandatory consumer rights in your place of residence.
